The Board of County Commissioners of Boulder County met in Regular Meeting in full conformity with the law and resolution of said Board at the regular place of hybrid meetings, 1325 Pearl Street, Boulder and on Zoom Webinar, on November 30, 2023. 

The meeting was called to order at approximately 8:51 a.m. by Chair Claire Levy.

Commissioner Marta Loachamin was excused from all public meetings and hearings on Thursday, November 30, 2023.

BOCC signature of an Intergovernmental Agreement (IGA) for the Lyons' trail project that supports the county's regional trail system plans and will serve as an important segment in creating the broader St. Vrain Greenway Trail that will ultimately connect from Lyons to Longmont.

Pursuant to CRS 24-90-107(2)(e), and the Interim Intergovernmental Agreement (IGA) dated June 16, 2023 between the City of Boulder, Boulder County and the Boulder Public Library District, these parties are entering into an Intergovernmental Agreement establishing that the City and County will continue to appoint library district trustees into the future, and establishing other obligations between the parties regarding annual reports and meetings related to Library District operations.

Resolution 2023-102, conditionally approving Boulder County Community Planning & Permitting Docket LU-23-0029: Gomez Vacation Rental.

The scope of St. Vrain Valley School District RE-1J’s (SVVSD’s) Project Launch program is to offer support to elementary and middle school students within grades K-8, with a focus on those who are below grade level in reading or math. The program offers summer support in both literacy and math at no cost to any student. The program serves students over a period of 16 business days for six hours per day (four days per week), totaling 96 contact hours.

The purpose of this contract is to provide countywide Housing-Focused Shelter (HFS) services to individuals who have been referred for services through the countywide Coordinated Entry (CE) system, including leveraging street outreach efforts to work with clients toward obtaining housing, in alignment with the system planning decisions determined by the Homeless Solutions of Boulder County (HSBC) governance structure.  This contract amendment is to extend the term and amount for 2024.

The Information Technology department is requesting approval of a contract amendment with ConvergeOne, providing data communication products and services. This is an amendment of $42,806 (Total 2023 Contract Amount of $524,562.23) to the active contract that will take effect from 11/3/2023 to 12/31/2027.  OFS# 302342-5

The Office of the County Administrator is requesting approval of an amendment to the contract with Keen Independent Research to include the City of Boulder in the contracting and procurement disparity study. The City of Boulder has requested to join Boulder County's disparity study. A Memorandum of Understanding has been signed between the City and County. This is an amendment of $234,884 (total 2023 contract amount $633,866) to the active contract that will expire on 8/31/2024. OFS# 303008-2

Boulder County proposes to acquire fee title to approximately 10.35 acres owed by Little Raven House LLC with associated water rights, for $55,000.00 The property has an address of 0 Peak to Peak Highway and is located about one-half mile from Left Hand Reservoir Road and southeast of Brainard Lake. 

Woodwardia Limited Partnership (Landowner) proposes donating its 5-acre vacant parcel (Property) to the county. The Property is located on the northwest edge of the Town of Eldora and has an address of 0 Eldorado Avenue (please see the maps at the end of this memo). The Property is surrounded by US Forest Service lands. Staff recommends approval.

Boulder County Sheriff's Office is amending our 2023 contract with CoreCivic adding an additional $60,000 to the original amount of $436,050. CoreCivic assists the Jail with inmate boarding and work release management.  

The Sheriff's Office contracts each year with Aramark Corporation who supplies the food services for the Jail.

As part of the Worthy Cause 2022 Fund Round, the county awarded Boulder Shelter for the Homeless $750,000 to purchase housing units in Boulder to be used for permanent supportive housing for hard-to-place clients. Boulder Shelter for the Homeless will purchase a total of 11 units as part of the project and the County will support funding of three of those 11 units. 

The County Attorney’s Office Risk Management Division is requesting a 2023 budget amendment in the amount of $1,285,000 for the Risk Fund 174 appropriation numbers GAF 2 ($400,000), GAF 4 ($36,000), and GAF 5 ($849,000). 


Ben Pearlman is requesting an increase to GAF 2 (Property) due to the multiple large property losses that have occurred in 2023. This includes the Parks Storage building that burned and a Parks rental house that had significant damage from frozen pipes. The increase to GAF 4 (Auto Physical Damage) is to cover costs associated with numerous county autos that were damaged due to accidents and hail. The increase to GAF 5 (Auto Liability) is due to an unforeseen large settlement at the CGIA limit for a serious auto accident with injuries.

The Public Works Department and County Risk Management request a one-time increase of $384,976 for fleet replacement vehicles (77030-Equipment) for Housing & Human Services, Coroner's Office, and Community Services.

On October 30, 2023, the Community Planning & Permitting Department issued a Determination Letter conditionally approving SPR-23-093 Dow-McVey Residence and Accessory Structures. Following the issuance of the Determination Letter, staff received one public comment in support of the approval, and one public comment raising issues with the approval. On November 13, 2023, Commissioner Stolzmann requested that the application be called up to a Business Meeting to determine whether or not a public hearing for the proposal should be held. Staff request that the Board of County Commissioners determine whether or not a public hearing shall be held for SPR-23-0093 Dow-McVey Residence and Accessory Structures.

The Boulder County Office of Sustainability, Climate Action and Resilience (“OSCAR”) is requesting that a sole source bid waiver be granted to Energy Outreach Colorado to allow for a new contract providing expanded income- qualified energy efficiency and wrap-around services to qualifying county residents.

The Boulder County Community Planning & Permitting Department is requesting the Board of County Commissioners adopt updated fees for the Secure Transportation Licensure Program to be in line with other jurisdictions with the IGA and to create a separate fee schedule from the regulations to be updated through a business meeting, rather than public hearing.
